West Tisbury Select Board Opts Out of Noise Bylaw

West Tisbury resident Marc Rosenbaum’s appeal for a Sunday and holiday ban on industrial construction and landscaping noise met with empathy, but no action from the town select board last Wednesday.

“I agree with Marc that we have … crossed this threshold, and the constant leaf blowers and constant mowing and constant landscaping crews working all the time is a problem and an irritant,” select board member Jessica Miller said.

“At the same time, I don’t see how [a ban] can be enforced,” Ms. Miller continued. “Having police chase every … sound offense would be a waste of resources.”

Enforcement was also an obstacle for board member Skipper Manter, a recently retired lieutenant with the town police force.

“It would be very challenging to decide what would be commercial or not commercial,” Mr. Manter said of Mr. Rosenbaum’s proposal, which has an exemption for residents working on their own properties.

Town administrator Jennifer Rand expressed concern that having police enforce a Sunday and holiday noise ordinance could “weaponize” disputes between neighbors.

While the select board was not willing to take up Mr. Rosenbaum’s proposed bylaw, chair Cynthia Mitchell recommended that he gather signatures for a petition article on the annual town meeting warrant next spring.

Ms. Miller endorsed the suggestion, with enthusiasm.

“I love the idea and welcome the idea of a citizen … bringing something to the town meeting floor,” she said.

“As a select board member, I don’t think we should be investing a lot of time in drafting the bylaw,” Ms. Miller added.

What about a neighborly message to West Tisburyites with suggested guidelines for town quiet times? Not everything has to be an enforceable law. Some things are just local etiquette that can be imparted.

Common courtesy would dictate no work before 9 Sundays and holidays.
Does WT have allowed working hours?
No loud noise before 7am for instance.
Most municipalities do.
Offenders will be known quickly and once’s fined may respect peoples quite times.
This morning someone in my neighborhood was using a leaf blower at 6am - kind of rude and ridiculous.
